Terms of Use
These terms govern your use of the Raritee mobile app and its related services (together, "Raritee", "we", "us"). By downloading or using Raritee you agree to these terms. If you do not agree, do not use the app. Our Privacy Policy explains how we handle your data.
1. The service
Raritee helps you identify Pokémon trading cards from photos, look up market prices and keep track of your collection and wishlist. Some features are free with usage limits; others require a paid subscription. We may change, add or remove features, and we may suspend or end the service, in whole or in part, at any time.
2. Your account
Raritee creates an anonymous account linked to your device. You are responsible for the use of the app on your devices. You can delete your account at any time in the app under Profile. We may suspend or delete accounts that break these terms or abuse the service.
3. Subscriptions and payments
- Subscriptions are sold and billed by the Apple App Store or Google Play, through the account you use in that store, and are subject to the store's terms. Prices are shown in the app before you buy.
- A subscription renews automatically at the end of each period at the then-current price unless you cancel it at least 24 hours before the period ends. Your store account is charged for renewal within 24 hours before the end of the current period.
- If a free trial is offered, the subscription starts and is charged when the trial ends unless you cancel before then.
- You manage and cancel subscriptions in the subscription settings of your App Store or Google Play account. Deleting the app or your Raritee account does not cancel a subscription.
- Refunds are handled by Apple or Google under their policies. We cannot issue refunds for purchases made through the stores.
- If you reinstall the app or change devices, you can restore your purchases from within the app.
4. Prices and card data
Card recognition results, card details and prices are provided by third parties, including Scrydex, and are estimates for information only. They may be incomplete, delayed or wrong, and a card may be recognised incorrectly. Prices do not reflect what any person will pay for a card. Raritee is not a marketplace and does not give financial, investment or appraisal advice. Check important information yourself before buying, selling or insuring cards.
5. Acceptable use
You agree not to:
- use Raritee for any unlawful purpose or to upload content you have no right to use;
- upload photos that are not of trading cards, or content that is offensive or harmful;
- access the service by automated means, scrape its data or exceed its usage limits;
- attempt to interfere with, disrupt, reverse engineer or gain unauthorised access to the service or its systems.
6. Your content
You keep any rights you have in the photos you upload. You allow us to store and process them, and to send them to our service providers, only to provide the service, as described in the Privacy Policy.
7. Intellectual property
Raritee, its software, design and branding belong to us or our licensors. We give you a personal, non-exclusive, non-transferable, revocable licence to use the app on devices you own or control, under these terms and the terms of the store you obtained it from.
Raritee is an independent app. It is not affiliated with, endorsed, sponsored or approved by Nintendo, The Pokémon Company, Creatures Inc. or GAME FREAK inc. Pokémon, the Pokémon Trading Card Game and related names and images are trademarks or copyrights of their respective owners and are used only to identify cards.
8. Disclaimer
Raritee is provided "as is" and "as available". To the fullest extent permitted by law, we make no warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement, and we do not promise that the service will be uninterrupted or error-free.
9. Limitation of liability
To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or goodwill, arising from your use of or inability to use Raritee, including decisions made on the basis of prices or recognition results shown in the app. Our total liability for any claim relating to Raritee is limited to the amount you paid for Raritee in the 12 months before the claim. Nothing in these terms limits liability that cannot be limited by law, or your statutory rights as a consumer.
10. Apple and Google
These terms are between you and us, not Apple or Google. Apple and Google are not responsible for Raritee or its content, have no obligation to provide maintenance or support for it, and are not responsible for any claims relating to it. If you obtained the app from the App Store, Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
11. Changes to these terms
We may update these terms. We will post the new version on this page with a new effective date. If you continue to use Raritee after a change takes effect, you accept the new terms.
12. Governing law
These terms are governed by the laws that apply to our business, without regard to conflict-of-law rules. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live, and you may bring a claim in the courts of that country.
